An introduction to and explanation of the Financial Ombudsman Service (“FOS”) system, its aims and values including the overriding requirement to make decisions which are “fair and reasonable”, how codes of practice fit into the legal and FOS systems and the effect of recent caselaw and incoming legislation.
Dr Summer is the 2011 Winner of the BILA Book Prize for her book “Insurance Law and The Financial Ombudsman Service” published by Lloyd’ sList/Informa Law
The presentation will consider the most important issues to emerge in the last year. These include: the remedies for misrepresentation; the nature of a fraudulent claim; post-contractual duties of brokers; coverage for catastrophic losses; the trigger for cover in liability policies; and causation.
