Four members of Crown Office Chambers will explore and discuss key insurance issues that arise from the fire safety and cladding claims that are ultimately being made against insurers under various types of policies following the Grenfell Tower Tragedy in 2017. Ben, Isabel, Ivor and Elizabeth will consider the various remedies that are now being sought in such claims and whether they neatly fit within the scope of cover available under various insurance policies. They will focus in particular on professional indemnity policies and the various limits that have been placed on cover by insurers in recent years.
Ben Quiney KC
Ben advises upon and litigates all insurance related disputes, including: D&O, PI, PL & EL, product liability, and Warranty and Indemnity policy disputes; dealing with insolvent insureds and insurance companies; subrogated recovery claims (including disaster claims); all coverage issues (including non-disclosure, notification, moral hazard, and warranty cases); and issues of scope of cover, such as business interruption.
Isabel Hitching KC
Isabel Hitching KC is a leading construction and insurance specialist. She has acted in many of the leading liability and coverage cases post Grenfell, ranging from LDC (Portfolio One) v (1) George Downing Construction (2) ESL [2022] EWHC 2256, the first case following introduction of the Building Safety Act 2022 to address the ability of a main contractor to flow down liabilities for defective cladding through to ongoing claims against insulation manufacturers under section 149 and coverage disputes as to the responsiveness of policies to the new forms of relief introduced by the Act. She is General Editor of Emden on Construction.
Ivor Collett
Ivor is instructed on a broad range of coverage and policy wording issues across most classes of business, with a particular emphasis on professional indemnity and construction-related matters. In recent years much of his work has involved policy disputes arising out of post-Grenfell fire safety claims, including issues of cover for design liabilities, aggregation across development projects and questions of cover for apparent strict liability causes of action.
Elizabeth Boon
Elizabeth is currently working on a number of cladding matters which involve a number of insurance issues, including those arising from the widened claims under the Defective Premises Act, Building Safety Act 2022 section 149 claims against well-known manufacturers, as well as both Remediation Orders and Remediation Contribution Orders in the First Tier Tribunal. Elizabeth also advises upon and litigates all insurance related disputes, particularly PI, PL & EL, and product liability; dealing with insolvent insureds and insurance companies; subrogated recovery claims; all coverage issues; and issues of scope of cover, such as claims for business interruption.
