With the law of fortuity and contractual prior acts exclusions (and many claims made policies now being “claims made and notified” – whilst notification law becomes stricter), combined with insurance market requests for no material claims declarations (and similar proposal form requirements) at renewal there has been a suggestion that there is a lack of continuity in insurance coverage under English law. Jamie Smith QC of 4 New Square will explore the reasons why an insured may not be certain that, between two insurers in consecutive years, he will be indemnified. The lecture will also look at aspects arising from the insurance Act 2015 in this area.
